1. Agreement to Terms

This End User License Agreement ("EULA", "Agreement") is a legal agreement between you ("User", "you") and Nikita Koniukh ("Developer", "we", "us") for the use of the KablanPro – Contractor Finance Manager iOS application ("the App").

This EULA also incorporates Apple's standard Licensed Application End User License Agreement as required by Apple's App Store guidelines.

2. License Grant

Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on Apple devices that you own or control
• Use the App solely for your personal or internal business purposes as a construction contractor or related professional

This license does not include the right to sublicense, distribute, modify, reverse-engineer, or create derivative works of the App.

3. Subscription Plans & Billing

KablanPro offers a Free tier and optional Pro subscriptions processed via Apple's App Store.

Subscription details:

• Pro Monthly and Pro Yearly are auto-renewable subscriptions managed entirely by Apple.
• Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID account at confirmation of purchase.
• You can manage or cancel your subscription at any time via iOS Settings → [Your Name] → Subscriptions.
• No refunds are provided for partial subscription periods, in accordance with Apple's App Store refund policy.

4. Restore Purchases

If you reinstall the App or switch devices, you can restore your existing Pro subscription by tapping "Restore Purchases" in the App's paywall screen. This requires being signed into the same Apple ID used for the original purchase.

5. User Data & Responsibilities

You are solely responsible for:

• The accuracy of all data you enter into the App (projects, expenses, invoices, client information)
• Maintaining backups of your data
• Compliance with any applicable laws when using the App for business purposes (tax reporting, contractor regulations, etc.)
• Securing your device and iCloud account to prevent unauthorized access to your financial data

The App is a financial management tool to assist your workflow. It does not constitute accounting, legal, or tax advice.

6. iCloud Sync

The App uses Apple's CloudKit to sync your data across your personal devices via your iCloud account. Enabling iCloud sync is optional. The Developer has no access to your iCloud data. Sync functionality is dependent on Apple's iCloud service availability and your active iCloud account.

7. Intellectual Property

The App, including all source code, design, graphics, features, and content, is the exclusive intellectual property of Nikita Koniukh and is protected by copyright law.

• You may not copy, modify, distribute, sell, or reverse-engineer any part of the App
• You may not remove or alter any copyright, trademark, or proprietary notices
• The App name "KablanPro" and all associated branding are proprietary to the Developer

8. Prohibited Uses

You agree not to use the App to:

• Violate any applicable local, national, or international laws or regulations
• Engage in any fraudulent financial activity or misrepresentation
• Attempt to decompile, disassemble, or reverse-engineer the App
• Circumvent subscription limits through unauthorized means
• Interfere with or disrupt the integrity of the App or its data

9. Disclaimer of Warranties

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Damages resulting from reliance on financial information generated by the App
• Service interruptions caused by iCloud or Apple's infrastructure

The Developer's total liability for any claim arising from use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Termination

This Agreement is effective until terminated. Your rights under this license terminate automatically and without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the App and delete it from your devices.

The Developer reserves the right to discontinue the App or any feature at any time without prior notice.

12. Third-Party Services

The App integrates with the following Apple platform services, each governed by their own terms:

• iCloud / CloudKit — for data sync
• Apple App Store / StoreKit — for subscription billing
• Apple Vision framework — for on-device OCR (no data leaves your device)
• Apple UNUserNotificationCenter — for local push notifications

The Developer is not responsible for the availability or practices of these services.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Israel.

14. Changes to This Agreement

The Developer reserves the right to modify this EULA at any time. Updated versions will be posted at this URL with a revised effective date. Continued use of the App after changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
